LangStart International is a web platform, available at https://www.langstart-international.com (the " Site ").
This Site is published by LangStart International, SASU with capital of 8,000 euros, having its registered office at 9 Rue des Colonnes, 75002 Paris, France and registered with the Paris Trade and Companies Registry under identification number 919108860, (hereinafter " the Publisher "). LangStart International is accessible to users (the " User (s ) ").
LangStart International is hosted by o2switch, headquartered at Chemin des Pardiaux, 63000 Clermont-Ferrand, France. This host can be contacted at the following e-mail address: support@o2switch.fr.
The purpose of these Terms and Conditions of Use (the " Terms" or, taken as a whole, the " Agreement ") is to define the terms and conditions governing the relationship between Users and LangStart International. In the event of non-compliance with the terms of the present Conditions, LangStart International reserves the right to take any measure likely to preserve its interests and, in particular, to ensure their enforcement.
Access to and use of the site are subject to acceptance of and compliance with these Terms of Use.
The Publisher reserves the right to modify, at any time and without prior notice, the Site and services as well as these GTC, in particular to adapt to changes in the Site by making new features available or deleting or modifying existing features.
The User is therefore advised to refer to the latest version of the Terms and Conditions of Use, which may be consulted at any time on the Site, before browsing.
These General Terms of Use apply, as necessary, to any declination or extension of the Site on existing or future social and/or community networks.
Article1: Purpose of the site
The Site allows the User to access the following services: Language stays abroad (the " Service(s) ").
LangStart International hereby grants Users a limited, revocable, non-exclusive, non-transferable right of access to the Services on a strictly personal basis. Any use of the Platform contrary to its purpose is strictly prohibited and constitutes a breach of these Terms.
Article 2: Access to the site
To be eligible for the Service, the User may be an individual or a legal entity.
LangStart International reserves the right to suspend or refuse access to the Site to one or more Users.
Article 3: Site management
The Publisher implements the necessary technical solutions to ensure uninterrupted access to the Site for the User. However, the Publisher reserves the right to limit or suspend access to all or part of the Site at any time, without prior notice. In particular, such an interruption may be necessary to maintain the site or its content, or for any other reason deemed necessary for the proper operation of the site by the Publisher.
Use of the Platform requires a connection and an Internet browser. The platform can be accessed at the following address: https://www.langstart-international.com.
All hardware and software required to access the Platform and use the Services are the sole responsibility of the User.

Article 5: Use of platform services
Users agree not to:
- transmit, publish, distribute, store or destroy any material, in particular LangStart International content, in violation of applicable laws or regulations concerning the collection, processing or transfer of personal information;
- to disseminate data, information or content of a defamatory, insulting, obscene, offensive, violent or inciting to violence nature, or of a political, racist or xenophobic nature and, in general, any content that is contrary to the laws and regulations in force or to accepted standards of behaviour;
- reference or create links to any content or information available from LangStart International sites, except with the express prior written consent of LangStart International;
- to use any information, content or data contained on the Site in order to offer a service considered to be competitive to LangStart International ;
- to sell, exchange or monetize information, content or data present on the Platform or Services offered by the Platform, without the express written consent of LangStart International;
- reverse engineer, decompile, disassemble, decrypt or otherwise attempt to obtain source code in connection with any underlying intellectual property used to provide all or part of the Services;
- to use any manual or automated software or devices, robots or other means to access, explore, retrieve or index any page of the Site;
- endanger or attempt to endanger LangStart International's digital security. This includes attempts to monitor, scan or test the vulnerability of the system or network or to breach security or authentication measures without express prior authorization;
- counterfeit or use LangStart International's products, logos, trademarks or any other elements protected by LangStart International's intellectual property rights;
- simulate the appearance or operation of the Site, for example by using a mirror effect;
- disrupt or interfere, directly or indirectly, with LangStart International, or impose a disproportionate load on the Site's infrastructure, or attempt to transmit or activate computer viruses via or on the Site;
Violations of system or network security may lead to civil or criminal prosecution. LangStart International verifies the absence of such violations and may call upon the legal authorities to prosecute Users who have participated in such violations.
Users undertake to use the Site in a fair manner, in accordance with its purpose and with the legal and regulatory provisions, the present Conditions and current practices.
Article 6: Intellectual property
All content on the Site, including but not limited to designs, text, graphics, images, video, information, logos, button icons, software, audio and other files, is the property of LangStart International, which is the sole owner of all intellectual property rights pertaining thereto.
Any representation and/or reproduction and/or use, in whole or in part, of the content and services offered by LangStart International, by any means whatsoever, without the prior written consent of LangStart International, is strictly prohibited and may result in legal action.
Article 7: Personal data
All personal data held by LangStart International is collected legally and fairly in accordance with the terms of the privacy policy accessible at this address: https://www.langstart-international.com/politique-confidentialite.
This data is provided by Users who voluntarily and expressly accept these Terms authorizing LangStart International to process, disclose or transfer such data to any third party in order to (i) enable the User to take full advantage of the Services and functions offered by the Site, (ii) prevent fraud and/or (iii) for statistical purposes.
Personal data is stored by LangStart International for processing in connection with the use of the Services. It is kept for as long as is necessary to provide the services and functions offered by the Site.
The User remains at all times the owner of the information concerning him/her that he/she transmits to LangStart International. In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, as consolidated on March 24, 2020, the User has the right to access, rectify and delete personal data concerning him or her, as well as the right to object to the communication of such data to third parties for valid reasons.

A reply to the User's request will be sent within 30 days.
Article 8: Liability
Users are reminded that data published by them and information shared by them may be collected and used by other Users or third parties. In this respect, LangStart International does not guarantee that the ownership of such data will be respected, and it is the User's responsibility to take all necessary steps to ensure that the ownership of his or her data is preserved.
LangStart International does not guarantee uninterrupted or error-free operation of the Services. In particular, LangStart International shall not be liable for any interruption of access to the Platform due to maintenance, updates or technical improvements.
In no event will LangStart International be liable for any indirect or consequential loss or damage to the User or any third party, including, without limitation, any lost profits, lost investments, inaccuracy or corruption of files or data, loss of image or business, loss of sales or profits, loss of goodwill or loss of opportunity, whether in contract, tort, strict liability or otherwise.
In addition, LangStart International shall not be liable for any delay or non-performance of this Agreement caused by force majeure, as defined by the case law of the French courts.
Article 9: Evidence agreement
Computer systems and files are authoritative in relations between LangStart International and the User.
Thus, LangStart International may validly produce in any proceedings, for purposes of proof, the data, files, programs, recordings or other elements, received, issued or stored by means of the computer systems operated, on any digital or analogue media, and rely on them unless there is an obvious error.
Article 10: Indivisibility
The fact that any provision of the Contract is or becomes illegal or unenforceable shall in no way affect the validity or enforceability of the remaining provisions of the Contract.
Article 11: Settlement of disputes
The conclusion, interpretation and validity of this Agreement shall be governed by French law, regardless of the User's country of origin or the country from which the User accesses LangStart International and notwithstanding the principles of conflict of laws.
In the event of a dispute concerning the validity, performance or interpretation of this Contract being brought before the civil courts, it will be submitted to the exclusive jurisdiction of the French courts, to which jurisdiction is expressly granted, even in the event of summary proceedings or multiple defendants.
The User is hereby informed that he/she may in any event have recourse to conventional mediation or any other alternative dispute resolution method (conciliation, for example) in the event of a dispute.
Article 12: Duration of the general conditions of use
These general terms and conditions of use are concluded for an indefinite period, and the User is bound by them from the moment he starts using the Services.
The Publisher reserves the right to modify this document at any time and without prior notice. Users will be informed each time the document is updated.
